EssilorLuxottica and Macy’s, collaborating with video footage from the robbery, concluded that the 61-year-old man was one of the robbers. Based on their findings, the police issued an arrest warrant. However, the man’s lawyer later presented evidence proving his alibi – he was actually 2,000 miles away in California at the time of the robbery.

Despite confirming his innocence, the man found himself arrested and faced with a robbery charge. It wasn’t until his arraignment that his lawyer and the prosecutor were able to establish his alibi, leading to the dismissal of the charges. Tragically, the man’s nightmare did not end there. Just hours before his release from jail, he was brutally assaulted.

The lawsuit further reveals that facial recognition technology, which employs AI algorithms to analyze human faces and create biometric templates, played a significant role in this wrongful arrest. Sunglass Hut, like many other establishments, collects customers’ biometric data through face-scanning technology. The court documents state that the accuracy of this technology is dubious in most cases, which led to the erroneous identification of the man in question.

EssilorLuxottica, which profits from its facial recognition software, allegedly used this unreliable technology to identify individuals accused of theft from Sunglass Hut. Despite knowing that the software had an error rate of nearly 90% when comparing unclear security footage to the man’s outdated mugshots from the 1980s, EssilorLuxottica and Macy’s confidently claimed to have found the perpetrator.

In seeking justice, the aggrieved man is now pursuing a lawsuit demanding $10 million in damages through a jury trial. The lawsuit exposes the flaws and potential dangers of relying solely on AI technology for identifying criminal suspects, emphasizing the urgent need for accuracy and accountability in its application.
