EU Lawmakers Pass Draft of AI Act Including Last-Minute Change on Generative AI Models

EU lawmakers have just passed a landmark draft of the Artificial Intelligence (AI) Act - the first ever comprehensive set of regulations related to AI. This comes after two years of intensive negotiations and months of haggling. The draft grants authorization to generative AI models like ChatGPT, requiring companies to disclose if copyrighted content is deployed in the system. Moreover, generative AI models must be designed, developed, and utilized in accordance with EU law and fundamental rights. Avi Gesser of Debevoise & Plimpton believes the risk-based regime of the AI Act ensures safety while encouraging innovation. This applies to organizations, both in the EU and third countries, whose AI systems' output is used in the EU.
