The new AI regulation proposed by the European Union could have a big impact on ChatGPT, the well-known AI chatbot. This was one of the first discoveries during testing of the AI which revealed that sources and citations used by the AI chatbot were often not disclosed. This could be seen as a larger problem within the industry which has drawn criticism from publishing companies and creative professionals alike, who want to both provide accurate information as well as credit those who created it.
The proposed AI regulation calls for developers of generative AI models to publish a “sufficiently detailed” summary of any copyrighted material used to create their AI model. This could potentially affect ChatGPT and other large language models, as these AI tools crawl data from the web and other curated datasets which could include copyrighted information such as song lyrics and computer code, which have the potential to be seen as copyright infringement. In fact, last November, the creators of ChatGPT, OpenAI, was sued for improper monetizing open-source code from GitHub to train the system.
The expectation is that the regulation will bring about global standards for AI regulation, much in the same way that the GDPR law has become a benchmark in privacy rules. This bill is still in the process of being finalized as member states of the EU must agree for it to be passed. However, the expectation is that it will be confirmed and implemented later this year.
