Lawyers have been warned against relying on artificial intelligence tools, such as ChatGPT, for legal research purposes. The warning comes after a number of cases in which lawyers reportedly submitted motion papers to courts based on fake cases created by the AI software. This is because the technology, in its current iteration, often produces “hallucinations” which provide false case citations and even the full text of non-existent cases to support them. Despite this, generative AI tools can be beneficial to lawyers, and are increasingly being incorporated into legal software platforms, provided they are used responsibly. Potential applications for the technology include templating, summarising provided documents and brainstorming legal issues.
