In order to have the ban lifted, OpenAI must ensure transparency over how user data is processed and acquire permission to use the data. Ethical use of AI and the protection of minors is a key factor for Garante and OpenAI. If the condition is met before April 30th, the ban will be lifted.

Despite its success, the collection and subsequent processing of data raised concerns from Italy, who was the first western nation to issue action against ChatGPT in March.
