Lawyers who used ChatGPT to fake opinions are coming under fire after citing non-existent cases in a lawsuit against Avianca Airlines. Attorney Peter LoDuca from Levidow, Levidow & Oberman PC cited fake cases in his Affirmation in Opposition, claiming that Avianca’s bankruptcy had tolled enough statute of limitations. Condon & Forsyth LLP, who represents Avianca, noticed the absence of such cases and demanded they be produced. After an additional week’s vacation, LoDuca submitted an affidavit with proof of the citations, which were proven to be non-existent. Both LoDuca and attorney Steven Schwartz hired counsel and requested an extension of time to prepare a response. Judge Kevin Castel has ordered an in-person hearing on June 9 and demanded a response from the lawyers on a false and fraudulent notarization in an affidavit filed on April 25, 2023.
