OpenAI, an artificial intelligence (AI) company, has been ordered by the Italian Data Protection Authority to comply with a list of steps if it wants ChatGPT to be unbanned in the country. OpenAI, who is behind the operation of the chatbot, must adhere to the authority’s requirements by April 30th.
OpenAI was taken down in Italy due to concern about their data collection policies and user privacy. Now, OpenAI will have to draft an information notice describing the arrangements and logic of the data processing required for the operation of ChatGPT. This notice should be easily accessible and placed in such a way as to be read before signing up to the service. Moreover, users in Italy will be required to declare that they are over 18 years old prior to signing up, while existing customers will have to pass an age gate.
OpenAI must also remove any references to contractual performance of data and rely on either consent or legitimate interest as the applicable legal basis instead. Additionally, customers will be able to rectify their personal data or request for its removal with a tool specifically made for OpenAI. Finally, OpenAI will have to advertise the changes via radio, television, newspapers and the internet in order to make the public aware of their data collection rights.
