The Italian government issued a report on ChatGPT and banned its use in the country because of its alleged lack of transparency with regards to data storage and usage. The EU subsequently proposed regulations to address the same concerns. In contrast, the UK government has a relatively liberal approach towards the use of AI applications and has not proposed any restrictions.
The use of ChatGPT has also raised questions about consumer protection laws. There is ambiguity regarding whether users of the free version of ChatGPT can be considered as consumers for the purposes of consumer protection laws. However, upgraded versions of ChatGPT with subscription fees could fall under the understanding of the definition. Liability issues associated with the accuracy of information generated by AI, along with source and biasness of information generated, makes the framing of rules and regulations all the more necessary.
A transparent algorithm and stringent laws are needed to address these issues. The lack of regulations can be a major threat to data protection and privacy laws. The expansion of AI bears the need for tighter regulations to guide the use of AI technologies and protect users from the deficiency in services or malfunctioning products.
While the recent technological developments have opened the gates for AI development, the absence of standardized regulations is a major concern. The need for proper regulatory frameworks and stringent laws and policies is the need of the hour.
