Diller spoke of the need for the industry to sue the makers of generative AI for the ingestion of text and content from articles without permission, suggesting that this conduct could amount to a form of infringement of copyright.
Federal copyright law indeed gives creators with registered copyrighted works the right to legally challenge such unauthorised use of their property. However, the application of such law to generative AI technology has yet to be tested, and as such, it remains unclear whether and to what extent copyright laws would be applied. According to Frank Gerratana, a partner at Mintz, who advises clients on intellectual property matters, it is possible that courts could issue rulings that apply copyright laws in ways which we hadn’t anticipated before.
