Italy to lift ChatGPT Ban if OpenAI Addresses Privacy Concerns

Italy’s data protection authority has recently blocked access to OpenAI’s ChatGPT, a chatbot created to emulate human conversation. This has sparked an investigation into whether the software meets Italy’s data privacy laws and the EU’s General Data Protection Regulation (GDPR).

Specifically, the GPDP (Guarantor for the Protection of Personal Data) was concerned that ChatGPT could recall and emit personal information, like phone numbers and addresses, and expose minors to inappropriate answers. As a solution, the GPDP has set a deadline of April 30th, 2023 and has proposed a solution to lift the ban on ChatGPT.

OpenAI is required to inform people on its website how ChatGPT stores and processes their data and to acquire consent from the user and their parents if they are under the age of 18. Additionally, OpenAI must offer an authentication process in order to verify the age of new users, and create a way for people to request any false personal information generated by ChatGPT to be amended and deleted. By September 30th, 2021, OpenAI must have implemented all of these new regulations, or the ban will be reinstated.
