US Judge Fines Lawyers for Using ChatGPT to Create False Legal Background

Two lawyers and a law firm have been fined $5,000 in an unprecedented case of using an artificial intelligence (AI) tool called ChatGPT to create fictional legal research in an aviation injury claim. The lawyers were accused of submitting non-existent judicial opinions with fake citations using ChatGPT, and then continuing to back up these fake opinions even after their existence was questioned by judicial orders. Judge P Kevin Castel, who imposed the fine, said the lawyers acted in bad faith and had abandoned their responsibilities. However, he also acknowledged that existing rules allow a gatekeeping role for attorneys to ensure the accuracy of filings. The lawyers apologised to the court and client, saying they believed a piece of technology could not create fake cases.
