Two US lawyers have been fined after relying on an AI-generated legal brief to support their client’s lawsuit against Avianca airline. Attorneys Peter LoDuca and Steven Schwartz submitted the brief, penned by AI tool ChatGPT, in March before continuing to stand by it despite judicial questioning of its validity. Both lawyers and their law firm, Levidow, Levidow & Oberman, were ordered to pay $5,000 in fines each. The judge also granted the airline’s request to dismiss the suit, filed on behalf of client Roberto Mata, who alleged he suffered knee trauma during a flight from El Salvador to New York City after being struck by a metal service tray. The attorneys were found to have exhibited bad faith in their continued use of the false statements in the brief.
